    En la presente ponencia, se discuten los derechos fundamentales definidos como aquellos que son mínimos, básicos e irrenunciables, es decir, son innatos a la naturaleza del ser humano. No se ostentan. El estado debe velar por la protección. Así lo contempla la Constitución y les establece un mecanismo de protección legal y judicial preferente y sumario. Asimismo se exponen algunos aspectos interesantes y aclaradores sobre los tratamientos ambulatorios involuntarios. En este sentido, la ley prevé dos instrumentos jurídicos de actuación cuando se considera con criterio médico que un paciente necesita una intervención médica y cuando el paciente realmente no quiere esa intervención: el internamiento y la incapacitación.

    In this paper, we comment upon the fundamental rights, defined as those that are minimal, essential, and irrevocable, that is, they are innate to the nature of the human being. They are not visible. The state should be responsible for their protection. This is contemplated in the Constitution, which establishes a preferential and summary mechanism of legal and judicial protection for these rights. Similarly, some interesting and clarifying aspects about involuntary outpatient treatments are discussed. In this sense, the law foresees two judicial action instruments: when, based on medical criterion, it is deemed that a patient requires medical intervention and when the patient really does not want such an intervention: hospitalization and incapacitation.
