    Después de una revisión general de la Ley de Propiedad Horizontal, especialmente en los aspectos intimamente relacionados con los aspectos de compra y conservación de apartamentos, se analizan las formas especiales de colaboración que surgen cuando el propietario cede la explotación del apartamento a una sociedad o gestor, participando así de los beneficios de una explotación mercantil

    The author poses the metter of the regulation of cooperative property which mainly refers to the conservation of a building owned by several persons as well as the new ways of management of profiteering dynamics raised as aconsecuence of the spanish touristic development. After a general examination of the Law of cooperative property in the aspeets closely related with real setate buying operations and conservation of apartments analyzes the special forms of collaboration which may appear when the propietor yields the profitable operation of the apartment to a society or individual management, thus sharing in the benefíts of a mercantile explotation.

    The enterpriser aims to make a profit with the means afforded by his partner normally in the title of use, a superior benefit to that which could be obtained which an investment of the civil kind. The prestation of the propietor is achieved through a contract which bestows the enterpriser with the faculty of enjoyment of an alien capital, in other events a settled amount. An essential feature of these contraets is that the capital brought in, namely the real property should be rendered when the time agreed for the association comes to an end.

    L'auteur expose le théme du rapport entre l'aménagement de la prpriété horizontale, qui tend fondamentalement á la conservation de l'immeuble dont sont copropriétaites plusieurs personnes et les nouvelles formes d'entreprises d'exploitation dynamique qui ont surgit par suite du développement touristique espagnol.

    Apres une revisión genérale de la Loi de la Propriété horizontale, dans les aspects se rapportant plus directement avec l'achat et conservation des appartements, il analyse les formes de collaboration spéciales qui surgissent quand le proprié- taire cede pour son exploitation l'appartement acheté á une société ou entrepreneur individuel, participant ainsi aux bénéfices d'une exploitation mercantile.

    L'entrepreneur désire un profit avec les moyens que luí procure son associé, normalement á titre d'usage, bénéfice qui est supérieur á celui qu'il obtiendrait d'une inversión de type civil. La prestation du propriétaíre se réalise á travers un contrat qui concede á l'entrepreneur la faculté de jouir du capital d'autrui, dans d'autres cas c'est une quantité fixe. II est essentiel dans ees contrats que le capital apporté, c'est á diré l'imnieuble, soit restitué á la fin du délai prévu pour l'association

    Der Verfasser wirft die Frage der Beziehung zwischen der Anordming des «horizontalen Eigenrums, —die grundlegend zur Erhaltung der Liegenschaften neigt, von denen verschiedene Personen Mit-eigentümer sind—, und den neuen unternehmenden Fonnen dr dynamisohen Ausbeutung auf, die dank der Entwicklung des Tourismus in Spanien aufgetreten sind. Nach einer allgemeinen Überprüfung des Gesetzes über das «horizontalen Eigentum», besonders im Hinblick auf den Ankauf und die Erhaltung der Unterkünfte, analysiert der Verfasser die besonderen Formen von Zusammenarbeit, die auftauchen, wenn der Eigentümer die gekaufte Wohnung für ihre wirtschatlichen Ausnutzung einer Gesellschaft oder einem einzelnen Unternehmer überlá'sst. So nimmt er an den Vorteilen einer kaufmannischen Ausnutzung teil.

    Der Unternehmer wünscht einen Gewinn zu bekommen mit den Mitteln, die ihm seine Gesellschafter verschafft, in allgemeinen unter dem Vorwand der Benutzung.

    Dieser Vorteil übertrifft immer jenen, der mit einer Kapitalsanlage ziviler Art erreicht wird. Die Zahlungsleistung des Eigentümers wird mittels eines Vertrages ausgeführt, der dem Unternehmer die Mbglichkeit zubilligt, mit einem fremden Kapital zu arbeiten. In anderen Fallen ist es eine feststehende Summe Geldes. In diesen Vertragen ist es wesentlich, dass das zugebrachte Kapital, das heisst, das Eigentum, am Ende der vertraglichen Frist für die Handelsverbidung zurüchkehrt.
