Resumen de La Política de Defensa de la competencia: objetivos, fundamentos y marco institucional

Este artículo justifica la importancia de la Política de Defensa de la competencia (PDC) y explica cómo han ido mejorando sus fundamentos analíticos, desde el paradigma inicial estructura-conducta- resultados hasta la nueva economía industrial. En particular, se analizan tres áreas ¿las fusiones horizontales, las prácticas colusivas y las restricciones verticales¿ relacionando los desarrollos analíticos con el cambio en los criterios seguidos por la PDC. Por último, se sintetizan los aspectos relativos al diseño institucional de los organismos de Defensa de la competencia haciendo referencia al Decreto de creación del Tribunal Vasco de Defensa de la Competencia.

This article tries to justify the importance of the Antitrust policy and to explain how its analytical fundamentals have been improved, from the initial paradigm structure-conduct-results to the new industrial economy. Three areas will be analysed ¿the horizontal mergers, the occlusive practices and the vertical restraint¿ relating the analytical developments with the change in the criteria followed by the Antitrust policy. Finally it will be given a synthesis about the aspects relative to the institutional design of the antitrust organisms, the fact that allows to make some commentaries about the decree which regulates the creation of the Basque Antitrust Court.

Artikulu honek Lehiaren Defentsarako Politikak (LDP) daukan garrantzia justifikatu nahi du, eta azaldu nahi du, orobat, nola joan diren hobetuz politika horren oinarri analitikoak: hasieran izan zuen egituraportaera- emaitzak paradigmatik, ekonomia industrial berrira arte. Hiru arlo aztertzen dira ¿fusio horizontalak, jarduera kolusiboak eta murrizketa bertikalak¿ bereziki; azterketa horren baitan, analisian izandako garapena eta LDPk jarraitu dituen irizpideetan izandako aldaketa lotzen dira. Azkenik, lehiaren defentsarako organismoen erakunde-diseinuaren inguruko alderdiak laburbiltzen dira; horrek aukera ematen du Lehiaren Defentsarako Euskal Auzitegia sortzeko dekretuaren gaineko zenbait komentario egiteko.
