Resumen de Explorando el vínculo entre la economía del copyright y la política de competencia: implicaciones para el bienestar general

  • The study and economic implications of the existence of copyright is the basis for copyright economics, where different trends of thought coexist feeding a group of arguments that hinder and enrich the research agenda. The combination of copyright and competition policy represents one the key arguments of copyright economics given the market power that the institution of copyright provides to the holder of the protected work.

    Despite sharing a same purpose, competition policy and copyright diverge in the chosen path to reach such purpose; which fosters the development of certain tensions. What are the keys of this argument? What tensions can occur? What link joins these institutions? Which elements, of inclusive nature, should inspire the design of institutional frameworks that, simultaneously, protect copyright and defend competition, with the common purpose of maximising social welfare? The present study aims, on one side, to study the economic analysis of copyright, specifically its confluence with competition policy, and on the other side, outline some elements for the design of an institutional framework that makes copyright and competition policy efficient instruments in the achievement of their aims.

    We should highlight copyright economics' potential as an area of specialisation in the economic analysis, specifically the rise of the approach that analyses copyright from the perspective of competition policy. In connection with the results obtained in the two empirical exercises developed, applying panel data techniques, we can say that competition policy and copyright must be applied in a complimentary way and intensively in favor of a greater social welfare.
