    Pensar en los Derechos Humanos, es anteponer el principio elemental de libertad, sin la cual no hay goce pleno de derechos. Esta es una premisa y parte del hecho que el hombre en toda su dimensión debe gozar y sentirse libre y llevarlo al plano de la realidad, para defender sus Derechos Humanos ante otros seres humanos. Una de las técnicas jurídicas con las que cuenta es la ponderación al momento de sopesar la forma de salvaguardar, los mecanismos ideales de defensa y en algunos casos la norma jurídica que le garantiza en teoría sus derechos, en la práctica debe ajustarse a la realidad social para hacer efectiva esa legítima defensa. La ponderación como metodología empleada en el ámbito jurídico, plantea una serie de pasos para lograr el éxito, entre ellas está la de establecer si existe o no colisión entre normas, y cuál de esas tiene mayor precedencia de acuerdo a su peso jurídico. Uno de sus precursores es Robert Alexys (2003), en su libro Ley de la ponderación.

    Thinking about human rights, is to put the basic principle of freedom, without freedom there is no full enjoyment of rights. This is a premise and partly from the fact that the man in all its dimensions should enjoy and feel free and take it to the level of reality, this way to de- fend their human rights to other human beings. One of the legal techniques with what counts is the balance at the time of weighing how to defend them ideal defense mechanisms and in some cases the rule of law that guarantees their rights in theory, in practice must conform to the social to enforce this self-defense. The weighting and methodology employed in the legal field, raises a number of steps to achieve success, among them is to establish whether there is collision between standards, and which of these standards has higher precedence ac- cording to their legal weight, one their pre- cursors is Robert Alexys (2003), in his book Weighting Act.
