Los peajes de la autonomía universitaria

    La autonomía universitaria consagrada a nivel constitucional, jurisprudencialmente configurada y legalmente desarrollada, constituye la piedra angular sobre la que reposa el funcionamiento de las Universidades Públicas. En la literatura jurídica podemos encontrar voces de gran prestigio que, fundamentalmente desde el mundo académico, han defendido a capa y espada este derecho, invocando los múltiples beneficios que de- rivan de su ejercicio. En este artículo, haciendo bueno el dicho de que no es oro todo lo que reluce, y partiendo fundamentalmente de los informes del Tribunal de Cuentas y los OCEX, se abordan algunos de los problemas que son consecuencia directa, en mayor o menor medida, de la autonomía universitaria y de la distribución de competencias diseñada por el legislador estatal para su salvaguarda. Problemas, que con independencia de la protección constitucional que se le otorga a su contenido, deberían hacer reflexionar al legislador estatal, si nos encontramos ante excesos y peajes ocasionales que deben ser soportados por la sociedad a la que sirven las Universidades o si,por el contrario,deben servir de fundamento para revisar la extensión y el alcance de autonomía universitaria.

    The university autonomy confirmed to constitutional level, jurisprudentially formed and legally developed, constitutes the cornerstone on which rests the functioning of the Public Universities. In the juridical literature we can find voices of great prestige that, fundamentally from the academic world, have defended to tooth and nail this right invoking the multiple benefits that derive from its exercise. In this article, making good the saying of which all that glitters is not gold, and departing fundamentally from the reports of the Spanish Court of Auditors and the OCEX, there are approached some of the problems that are a direct consequence, to greater or lesser degrees, of the university autonomy and of the distribution of powers designed by the state legislator for its safeguard. Problems, regardless of the constitutional protection given to its content, should make think over to the state legislator, whether we are faced with occasional excesses and tolls that must be supported by society or whether, instead, they should serve as a basis to assess the extent and scope of university autonomy.
