    Este trabajo prueba que la propiedad privada sobre bienes materiales encuentra su título en la justicia distributiva y en el principio de subsidiaridad. Refuta las concepciones liberal lockeana y marxista del derecho de propiedad. En particular, sostiene que los males que los marxistas atribuyen a la propiedad privada como a su causa se deben más bien al carácter de los hombres y no se resolverían, sino que se agravarían, con la abolición de la propiedad. Muestra que hay diversos posibles regímenes justos de propiedad y que debe revisarse hondamente el sistema de “propiedad intelectual”. Sostiene que la propiedad privada sobre bienes intelectuales es, en cambio, contraria a la subsidiaridad.

    The paper proves that one is entitled to have privateproperty due to distributive justice and to the principle of subsidiarity.It refutes the Liberal-Lockean and the Marxist conceptions of theright to property. It demonstrates, in particular, that the evils whichMarxist thinkers consider as flowing from private property as theircause would not disappear but, rather, worsen if private propertywere abolished. It demonstrates that there are a variety of possiblejust property systems and that the system of “intellectual property” must be submitted to a thorough revision. It holds that private property concerning intellectual rights is contrary to subsidiarity.
