    La Constitución argentina de 1949, que sancionaba la consolidación del peronismo en el poder, retomaba en su normativa un conjunto de demandas y derechos en materia social y económica. Este proceso se desarrollaba en un contexto doblemente complejo, tanto en lo que hacía al viejo debate sobre la intangibilidad de la Constitución de 1853, como a la discusión sobre la naturaleza del régimen social y político que se estaba instaurando en ese momento y, por ende, del tipo de oposición que reclamaba. Nuestro trabajo se propone estudiar, en clave comparada, tres discursos jurídicos característicos de esa coyuntura: el nacionalista, el socialista y el peronista, con el fin de determinar los alcances de ese primer "constitucionalismo social" argentino.

    Argentina's Constitution of 1949, which sanctioned the consolidation of Peronism in power, assumed a set of politics and rights in social and economic matters. This process was conducted in a complex context, that touch the old debate about the sanctity of the Constitution of 1853, and the discussion about the nature of social and political regime that was being established at that time, and thus, the type of opposition that was claimed. Our essay aims to study in comparative way, three characteristics of legal discourses of that juncture: the nationalist, the socialist and the peronist, in order to determine the scope and the specificity of the first Argentine "social constitutionalism".
