    El régimen legal de protección de los diseños industriales en los Estados Unidos de América es bastante complejo. Está compuesto de un régimen principal de protección (bajo la forma de una patente de diseño industrial [Design Patent]) y de sistemas subsidiarios tomados de otros regímenes de protección.

    Como se verá a lo largo de este documento, aunque en los Estados Unidos existe interés en disponer de un sistema único y coherente de protección de los diseños industriales, las numerosas tentativas legislativas que ha tenido el gobierno estadounidense en este sentido no han sido suficientes para que se disponga hoy en día de tal sistema.

    En América Latina, en razón del origen más o menos común de la fuente de origen de su derecho, el régimen de diseños y modelos industriales tiene numerosas semejanzas aunque también algunas diferencias que es interesante conocer con el fin de lograr una visión lo más amplia posible de la manera como se regula el diseño y los modelos industriales en el continente americano.

    The legal regime for the protection of industrial designs in the United States of America is quite complex. It consists of a main protection (in the form of a patent for industrial design [Design Patent]) and subsidiary systems from other protection schemes.

    As will be seen throughout this document, although in the United States there is some interest in having a single, coherent system of protection of industrial designs, the numerous legislative attempts that the American government had in this regard have not been sufficient to develop such a system.

    In Latin America, because of the common origin of the source of its legal system, industrial designs have many similarities but also some differences that are worth it knowing in order to achieve the broadest possible view of the way that the industrial designs are protected in the Americas.
