Régimen económico del matrimonio español desde la codificación hasta la reforma de 1981

    En este artículo se presentan los resultados de la investigación realizada sobre la evolución del régimen económico matrimonial en España, y particularmente, de la sociedad de gananciales en lo concerniente a la responsabilidad de los cónyuges frente a terceros acreedores y a los bienes que garantizaban tales obligaciones, durante el proceso de codificación y hasta sentar las bases de la Reforma ocurrida en 1981. Este proceso se caracterizó por la preponderancia del marido en la gestión de los bienes del matrimonio y, por tanto, en la potestad para endeudarlo. Sin embargo, en la segunda mitad del siglo XX se muestra una clara tendencia hacia la búsqueda de la igualdad en la gestión y disposición de los bienes gananciales, objetivo que se logra con la reforma de 1981, en la cual se modifica la tradicional administración por un régimen que muestra una sociedad compleja pero viva durante su existencia, destacándose el respeto de la garantía de los terceros acreedores del consorcio.

    This article presents the results from a research made about the marital economic regime in Spain, and specifically, the responsibility of the spouses in front of third creditors and the goods that guarantee those obligations, from the process of code building until the foundations of the reform in 1981 were stood. This process was characterized by the priority given to the husband in the management of the marriage goods and therefore, his possibility of lending them. Nevertheless, by the second half of the twentieth century there is a clear tendency to reach equality in the management and disposal of the marital estate. This objective was reached with the 1981 reform, where the traditional management is modified by a regime expressive of a complex but living society during its existence, standing out the respect for the guaranties given to the third creditors of the partnership.
