    The present study aimed at understanding the unrestricted exercise of freedom of expression in the face of the democratic regime, based on thepremise of the realization of human dignity and the non-assertion of an absolute character to fundamental rights. Based on this, the following question was established as a starting point: What should be done when the exercise of freedom of expression hurts the exercise of other freedoms? In the search for this answer, a qualitative approach was adopted, in law, and the hypothetical deductive method was used for the construction of this question. Furthermore, a theoretical bibliographical review was carried out in the search for scientific literature related to the theme, and the documental method was used, being configured as exploratory as to the objectives.From the present work, within its structural limitations, it was demonstrated that the democratic regime presupposes the equal participation of the members of society under its command, for which the exercise of fundamental rights must be made compatible with the legal and factual possibilities, and that excesses in the exercise of rights must be penalized. Thus, it was concluded that prior censorship is forbidden, but it is corroborated the need to hold responsible the propagators of hate speech that makes the participation of groups of individuals in the public debate impossible, as well as the use offreedom of speech itself to combat such speeches.

    Objetivou-se no presente estudo compreender o exercício irrestrito da liberdade de expressão em face do regime democrático, partindo-se da premissade realização da dignidade humana e não conferência de caráter absoluto aos direitos fundamentais. A partir disso, estabeleceu-se como pergunta de partida aseguinte: O que fazer quando o exercício da liberdade de expressão fere o exercício de outras liberdades? Na busca da presente resposta, adotou-se uma abordagem qualitativa, em direito, e utilizou-se do método hipotético dedutivo para a construção do presente questionamento. Ademais realizou-se uma revisão teórico bibliográfica na busca por literatura científica conexa ao tema, bem como fez-se uso do método documental, configurando-se como exploratória quanto aos objetivos. A partir do presente trabalho, dentro de suas limitações estruturais, demonstrou-se que o regime democrático pressupõe a participação igualitária dos membros da sociedade sob seu mando, para tanto o exercício de direitos fundamentais devem ser compatibilizados com as possibilidades jurídicas e fáticas, ademais os excessos no exercício dos direitos devem ser penalizados. Sendo assim, concluiu-se pela vedação da censura prévia mas corrobora-se a necessidade de responsabilizar os propagadores de discursos de ódio que inviabilizam a participação de grupos de indivíduos no debate público, bem como o uso da própria liberdade de expressão para combater tais discursos.
