Resumen de Regularização Fundiária Urbana como Instrumento de Desenvolvimento na Perspectiva de Amartya Sen

The present study carries out the analysis about the Urban Land Regularization being an instrument for development in the perspective of Amartya Sen. Thus, in chapter one it is verified what is meant by development and law and what is Amartya Sen's contribution on the subject. In chapter two, it investigates what would be Urban Land Regularization provided for in Law No. 13.465/2017, as well as its main characteristics and functions. Finally, in chapter three, we investigate whether Land Regularization can contribute to development. Therefore, weconcluded that regularization and efficient redistribution of property in society is a form of freedom in Amartya Sen's perspective, in addition to expanding the opportunities of the benefited individuals.

O presente estudo realiza a análise acerca da Regularização Fundiária Urbana ser um instrumento para desenvolvimento na pespectiva de Amartya Sen. Assim, no capítulo um verifica-se o que se entende por desenvolvimento e direito, além de apontar a contribuição de Amartya Sen sobre o tema. No cápitulo dois se investiga sobre o que seria Regularização Fundiária Urbana prevista na Lei Nº 13.465/2017, bem como suas principais caracteriticas e funções. Por fim, no cápitulo três se investiga se a Regularização Fundiária pode contribuir para o desenvolvimento. Conclui-se que regularização e redistruição eficiente da propriedade na sociedade é uma forma de liberdade na pespectiva de Amartya Sen, além de expandir as oportunidades dos indíviduos beneficiados.
