Resumen de Impactos da Aprovação do Projeto de Lei que Regula as Prestadoras de Ativos Virtuais no Brasil

This article aims to address the impacts on the financial market and investors of the approval of Bill n. 4,401/2021, which rgulates virtual asset service providers, pending in the Brazilian Legislative Power and currently awaiting consideration by the plenary of the Chamber of Deputies. The objective of the investigation rests on the importance of verifying the effects of the approval of the aforementioned Bill, since operations involving virtual assets have grown significantly, presenting themselves as an alternative for financial investment. For the development of the study, the methodology used will be the detailed analysis of the content of PL 4.401/2021, focusing on the changes that each of the articles will bring to the daily lives of those who invest in this type of assets, as well as those who are service providers involved in these operations. The relevance of this study is due to the finding of business growth involving cryptoassets. The proposed wording of the Bill aims to protect the economic-financial order and provide a safe environment for the virtual assets market. With increased security in thesebusinesses, the risk of scams and fraud is mitigated. Furthermore, the text provides that service providers operating in this sector are treated as financial institutions, therefore regulated and supervised by the Central Bank of Brazil and the National Monetary Council. In this study, the extension of the aforementioned Bill will be analyzed, as well as the potential for protecting investors from the provisions contained in its text.

O presente artigo pretende abordar os impactos ao mercado financeiro e aos investidores da aprovação do Projeto de Lei n. 4.401/2021, que dispõe sobre prestadoras de serviços de ativos virtuais, em trâmite no Poder Legislativo brasileiro e atualmente aguardando a apreciação pelo plenário da Câmara dos Deputados. O objetivo da investigação repousa na importância de se verificar os efeitos da aprovação do supra referido Projeto de Lei, vez que as operações envolvendo ativos virtuais têm crescido significativamente, apresentando-se como alternativa de investimento financeiro. Para desenvolvimento do estudo, a metodologia utilizada será a análise detalhada doconteúdo do PL 4.401/2021, concentrando-se nas alterações que cada um dos artigos trará ao cotidiano daqueles que investem nessa modalidade de ativos, bem como daqueles que são prestadores de serviços envolvidos nessas operações. A pertinência desse estudo se deve à constatação do crescimento de negócios envolvendo criptoativos. A proposta de redação do Projeto de Lei objetiva proteger a ordem econômico-financeira e propiciar um ambiente seguro para o mercado de ativos virtuais. Com o incremento da segurança nesses negócios, o risco de golpes e fraudes é mitigado. Ademais, o texto prevê que as prestadoras de serviços que operam nesse setor sejam equiparadas as instituições financeiras, portanto reguladas e fiscalizadas pelo Banco Central do Brasil e Conselho Monetário Nacional. Neste estudo, será analisada a extensão do mencionado Projeto de Lei, bem como o potencial de proteção aos investidores das disposições constantes de seu texto.
