Resumen de O controle do sistema de precedentes no Brasil através das súmulas vinculantes

  The Civil Law system was adoppted in Brazil, following the roman-greek tradition of Law, since the colonization times. However, the modifications at the State form, mainly the arrival of the federative pact, the precedents system, having special emphasis to the jurisprudence to solve the omitted cases, is becaming more and more relevant, being controled, in ultimate instance by the adoption of binding summaries. This fact brings an approach with theCommon Lawsystem, using the stare decisis ́ atribute and the possibility of chancing effects in overruling cases.In the present article, one dealed about conceptualizing the difference between judicial decisions, precedents, jurisprudence and binding summaries, witch is does a relationshionship between the mentioned institutes. The conclusion of the present work is that, though the theme may be awfully complex and needs more careful exam, one may say that binding summaries are powerful processual instruments to the precedents ́system control in Civil Law tradition, because they enforce the Efficiency principle, the Isonomy principle and also the Legal Security principle. In other hand, when the precedents do not become binding summaries, that enforces the diffuse constitutionality control, where each judgehas the jurisdiction power, what in Icommon Law can be translated in a more profound comprehension that, in deed, the judge creates the law, and we call it judge law.

  A Civil Law foi o sistema adotado no Brasil, seguindo a tradição greco-romana, desde os tempos de colonização. No entanto, com as modificações na forma de Estado, principalmente com o advento do pacto federativo, o sistema de precedentes, dando-se ênfase à jurisprudência para resolver os casos omissos, vem sendo cada mais relevante, e sendo controlado, em última instância pela adoção das súmulas vinculantes. E isso traz uma aproximação do sistema da Common Law, utilizando-se do atributo da stare decisis e da possibilidade de modulação de efeitos da decisão em casos de overruling.No presente artigo, tratou-se de conceituar a diferença entre decisões judiciais, precedentes judiciais, jurisprudência e súmulas vinculantes, fazendo-se correlação entre os citados institutos. A conclusão do presente trabalho é que, embora o tema seja bastante complexo e careça de estudos mais aprofundados, tem-se que as súmulas vinculantes são instrumentos processuais importantes para o controle dos precedentes no sistemadaCivil Lawporque reforçam o princípio da eficiência, o da isonomia e o da segurança jurídica. Por outro lado, quando os precedentes não viram súmulas, isto reforça o sistema de controle difuso, onde cada juiz tem poder de jurisdição, que no direito daCommon Law,traduz-se numa compreensão mais profunda, de que, na realidade, ele cria o direito e isto é chamado dejudge law.
