  A nivel mundial el uso de nuevas tecnologías como la Inteligencia Artificial (IA) ha asentado una nueva problemática, los ciberdelitos, más concretamente el robo de identidad. Según datos del Banco de México, México es el octavo país a nivel mundial por este tipo de delitos, por ello resulta sorprendente que su Código Penal Federal aún no tipifique la usurpación o robo de identidad. El objetivo de este trabajo es analizar, la problemática que representa la comisión de este delito en la sociedad mexicana. Mediante un análisis metodológico exploratorio empírico, legislativo y documental, para comprender el alcance de los daños provocados y las posibles soluciones que el estado mexicano debe implementar. Esperando que los resultados ofrezcan una visión clara sobre la naturaleza del robo de identidad y sirvan de base para recomendaciones que fortalezcan el marco legal y las prácticas de prevención en el país. En conclusión, es crucial abordar esta problemática actual de manera integral para proteger a los ciudadanos y reducir la incidencia de este delito.

  Worldwide, the use of new technologies such as Artificial Intelligence (AI) has established a new problem, cybercrime, more specifically identity theft. According to data from the Bank of Mexico, Mexico is the eighth country worldwide for this type of crime, so it is surprising that its Federal Penal Code does not yet criminalize identity theft. The objective of this work is to analyze the problem that the commission of this crime represents in Mexican society. Through an empirical, legislative and documentary exploratory methodological analysis to understand the extent of the damage caused and the possible solutions that the Mexican state must implement. Hoping that the results will provide a clear picture of the nature of identity theft and serve as a basis for recommendations to strengthen the legal framework and prevention practices in the country. In conclusion, it is crucial to address this current problem in a comprehensive way to protect citizens and reduce the incidence of this crime.
