Resumen de La responsabilidad legal del estudiante de ciencias médicas dentro de la práctica asistencial docente

  El papel del estudiante en las disciplinas sanitarias es esencial en la prestación de servicios de salud. Su creciente participación activa, aunque menos supervisada, ha llevado a un aumento en los procesos judiciales en los que se le involucra directa o solidariamente en casos de daño al paciente. Este estudio tiene como objetivo determinar la responsabilidad legal del estudiante en el ámbito médico y analizar la normativa que respalda sus acciones. Esta investigación cualitativa, con un diseño narrativo descriptivo, se centra en un caso judicial en Chile que involucra a una estudiante de enfermería, relacionando la discusión con la normativa legal del programa de Internado Rotativo en Ecuador. El análisis revela que el marco legal que rige la práctica docente asistencial es insuficiente para comprender completamente la responsabilidad legal del estudiante de ciencias de la salud frente a las acusaciones de negligencia médica. Este vacío legal plantea preguntas importantes sobre cómo deben estructurarse las regulaciones para salvaguardar tanto a los pacientes como a los estudiantes, resaltando la necesidad de una revisión y clarificación de las normativas existentes para garantizar una práctica médica ética y segura.

  The role of the student in health disciplines is essential in the provision of health services. Their increasing active participation, although less supervised, has led to an increase in legal proceedings in which they are directly or jointly and severally involved in cases of patient harm. This study aims to determine the legal responsibility of students in the medical field and to analyze the regulations that support their actions. This qualitative research, with a descriptive narrative design, focuses on a judicial case in Chile involving a nursing student, relating the discussion to the legal regulations of the Rotating Internship program in Ecuador. The analysis reveals that the legal framework governing teaching practice is insufficient to fully understand the legal responsibility of the health sciences student in the face of allegations of medical malpractice. This legal vacuum raises important questions about how regulations should be structured to safeguard both patients and students, highlighting the need for a review and clarification of existing regulations to ensure safe and ethical medical practice.
