    This article develops aspects of the contemporary debate regarding the return of cultural artifacts that make up the collection of museums located in the main capitals of the world, a topic that has gained prominence as global society reevaluates historical power relations and seeks reconciliation with the injustices of the past. The objective of the investigation is to examine the existing legal mechanisms thatguide respect for cultural heritage and attempt to promote the recovery of cultural assets that are in the possession of museum institutions, evaluating the effectiveness of the current international legal framework, identifying gaps and areas in need improvement, and proposing a reflection on practices and policies related to cultural restitution and repatriation. The research methodology covers the review of international legislation, with data collection carried out from primary and secondary sources, including legal documents, scientific articles and books. The complexity of balancing legal and logistical interests in the return/repatriation of cultural artifacts is reiterated, requiring practical solutions and international cooperation. The relevance of international legal frameworks, such as the UNESCO Conventions, is revealed, but the effectiveness of this order is questioned in the face of arguments of resistance that will only be overcome with a more holistic and cooperative approach between the countries and institutions involved.

    O presente artigo desenvolve aspectos do debate contemporâneo a respeito da devolução de artefatos culturais que compõe o acervo de museus localizados nas principais capitais do mundo, um tema que tem ganhado destaque à medida que a sociedade global reavalia as relações de poder históricas e busca reconciliação com as injustiças do passado. O objetivo da investigação é examinar os mecanismos legais existentes que orientam o respeito ao patrimônio cultural e tentam promover a recuperação de bens culturais que se encontram sob a posse de instituições museológicas, avaliandoa eficácia do quadro legal internacional atual, identificando lacunas e áreas que necessitam de aperfeiçoamento, e propondo uma reflexão sobre as práticas e políticas relacionadas à restituição e à repatriação cultural. A metodologia de pesquisa abrange a revisão da legislação internacional, sendo a coleta de dados realizada a partir de fontes primárias e secundárias, incluindo documentos legais, artigos científicos e livros. Reitera-se a complexidade de equilibrar interesses legais e logísticos na devolução/repatriação de artefatos culturais, exigindo soluções práticas e cooperação internacional. Revela-se a relevância dos marcos legais internacionais, como as Convenções da UNESCO, mas questiona-se a eficácia desse ordenamento diante de argumentos de resistência que só serão vencidos com abordagem mais holística e cooperativa entre os países e as instituições envolvidas.
