    This article aims to encourage the debate between the presumption of innocence and early serving of the sentence, due to conviction by the Jury Court, a thesis that already has most of the Federal Supreme Court to declare constitutional. In fact, it demonstrates the incompatibility of such a measure with the individual guarantee of being considered innocent until the final criminal sentence is reached. Thus, demonstrating the complexity of the right to punish and the right to individual freedom. The analysis will be based on the protection of human rights and systemic interpretation of the Federal Constitution and the Code of Criminal Procedure, all under the focus of the indefeasibility of the presumption of innocence.

    O presente artigo tem por objetivo fomentar o debate entre a presunção de inocência e o cumprimento antecipado da pena, por força de condenação pelo Tribunal do Júri, tese essa que já conta com maioria do Supremo Tribunal Federal para declarar constitucional. De plano, demonstra-se a incompatibilidade de tal medida com a garantia individual de ser considerado inocente até o trânsito em julgado de sentença penal condenatória. Demostrando, assim, a complexidade do direito de punir e o direito a liberdade individual. A análise será feita com base na proteção dos direitos humanos e interpretação sistêmica da Constituição Federal e do Código de Processo Penal, tudo sob o enfoque da inafastabilidade da presunção de inocência.
