Resumen de Os direitos laborais e sociais conquistados com a revolução do 25 de abril de 1974

This work aims to present initial reflections on the achievements of the April 25 Revolution in the field of labor relations in comparison with the authoritarian, dictatorial and fascist regime of the Estado Novo period. The aim of the study was to carry out a doctrinal and legislative analysis centered on the study of workers' struggles and achievements. It was found that the Portuguese Constitution of 1976 and the national legal provisions that embody and densify the constitutional rules applicable in this area, as well as the international conventions that were born with democracy, come to include a set of inalienable rights and benefits for workers, such as the right to a minimum wage, the right to freedom of association, the right to strike, the right to collective bargaining, the right to work and rest and limits on working hours. It can be concluded that the achievements of workers in terms of democracy since April 25, 1974, and achieved over time to the present day, centered on social and labor rights, have contributed to human dignity.

O presente trabalho visa apresentar reflexões iniciais sobre as conquistas da Revolução do 25 abril no âmbito das relações de trabalho em confronto com o regime autoritário, ditador e fascista do período do Estado Novo. No estudo pretendeu-se uma análise doutrinária e legislativa centrada no estudo das lutas e conquistas dos trabalhadores. Constatou-se que a Constituição Portuguesa de 1976 e as disposições legais nacionais que corporizam e densificam as normas constitucionais aplicáveis nesta matéria, bem como, as convenções internacionais que nascem com a democracia, passam a contemplar um conjunto de direitos e regalias inalienáveis para os trabalhadores, tais como o direito a um salário mínimo, o direito à liberdade sindical, o direito à greve, odireito à contratação coletiva, o direito ao trabalho, ao repouso e os limites de duração do trabalho. Conclui-se que as conquistas dos trabalhadores com o 25 de abril de 1974 em termos de democracia e alcançadas ao longo dos tempos até à atualidade, centrados nos direitos sociais e laborais contribuíram para a dignificação humana.
