El presente trabajo se desarrolla sobre la base del Derecho a la Educación y la adhesión a los Instrumentos Internacionales de protección de los Derechos Humanos que poseen las Primeras Naciones en América Latina, desde el que se ofrece un análisis de las bases Constitucionales de la Educación en relación con dicho derecho. En específico, se estudian catorce países de América Latina y sus respectivas Constituciones Políticas para describir cómo estas reflejan la Educación Intercultural Bilingüe como un derecho humano, y hasta dónde llega ese poder legal en la realidad y pertinencia de los sistemas educativos en el nivel regional; ya que en ocasiones los Estados y las políticas gubernamentales que implementan no logran valorar correctamente los Derechos Humanos de los Pueblos Originarios como Derechos adquiridos con dificultad y a destiempo, sino que confunden Derechos reconocidos, con privilegios y concesiones.

The present work is based on the Right to Education and adherence to the International Instruments for the protection of Human Rights held by the First Nations of Latin America, to develop an analysis of the Constitutional foundations of Education in relation to this right. Specifically, fourteen Latin American countries and their respective Political Constitutions are studied to describe how they reflect Bilingual Intercultural Education as a human right. It is also analyzed how far this legal power reaches in the reality and relevance of educational systems at the regional level; since sometimes the States and their government policies fail to assess correctly the Human Rights of the Original Peoples, as acquired rights with difficulty and at an inopportune moment, but that instead they confuse recognized rights with privileges and concessions.
