    El presente trabajo tiene por objeto hacer un estudio sobre el discurso del odio o hate speech, partiendo sobre la distinción que debe hacerse entre éste y discriminación. Ver cómo la jurisprudencia internacional ha optado por concepciones más liberales o restrictivas en esta materia. Posteriormente se analizará la regulación del hate speech en nuestro país, haciendo referencia a las normas vigentes y proyectos de ley en trámite.  Finalmente, se hará un análisis de la estructura del  hate  speech,  de los criterios que deben considerarse para evaluar un discurso y cómo el hate speech propiamente tal, constituye una limitación a la libertad de expresión.

    The purpose of this paper is to study hate speech, based on the  distinction  between  hate  speech  and discrimination. See how international jurisprudence has opted for more liberal or restrictive conceptions in this matter. Afterwards, the regulation of hate speech in our country will be analyzed, making reference to the current norms and bills in process. Finally, an analysis of the structure of hate speech will be made, of the criteria that should be considered to evaluate a discourse, and how hate speech proper, constitutes a limitation to freedom of speech.
