  En este artículo, los autores analizan cuál es la base del derecho de los reporte-ros para proteger la confidencialidad de sus fuentes en Perú y en el sistema interamericano de derechos humanos. Los autores argumentan que el origen de este derecho no radica en la protección del secreto profesional, sino en las libertades de información y de prensa. En consecuencia, los periodistas, y no las fuentes de información, son los titulares de este derecho. Aunque el estudio comienza con el caso peruano, sus observaciones pueden ser exportadas a otros sistemas legales, especialmente cuando los periodistas están expuestos a requerimientos de información y redadas estatales.

  In this article, the authors analyze what the basis is for the reporters’ right to protect the confidentiality of their sources in Peru and in the Inter-American Human Rights System. The authors argue that the origin of this right does not lie with the protec-tion of professional secrecy, but in the freedoms of information and of the press. Consequently, journalists, and not the sources of information, are the holders of this right. Although the study starts with the Peruvian case, its observations can be exported to other legal systems, especially where journalists are exposed to information requirements and state raids.
