Resumen de Bullying e cyberbullying no contexto escolar: uma revisão de literatura acerca da responsabilidade civil dos estabelecimentos de ensino e demais responsáveis

  The present research aimed to analyze the state of the art about the civil liability of educational establishments and others responsible in cases of bullying and cyberbullying, based on theses, dissertations and articles produced in Brazil, between the years 2013 and 2022. Concerning the methodological procedure,it is a bibliographic research of the literature review type, in which a systematic survey was carried out in the Catalog of Dissertation Theses of the Coordination for the Improvement of Higher Education Personnel (CIHEP) and in the Periodicals from CIHEP. Initially, 78 studies were found. After applying the inclusion and exclusion criteria, 12 studies were selected, being 02 theses, 03 dissertations and 07 articles, to compose the corpus of analysis. The results revealed that, in most of the legal studies reviewed, parents are identified as responsible for their children's education, and there should be greater care in relation to the use of electronic devices. They also showed that educational establishments have legal duties to prevent, restrain and deal with situations of bullying and cyberbullying, and cannot be exempted from this obligation. It was concluded that it is up to the State to develop and implement public policies to provide the adequate insertion of children and teenagers in the digital environment, promoting adequate and effective preventive measures to protect them from risks of damage to their existential sphere.

  A presente pesquisa teve como objetivo analisar o estado da arte sobre a responsabilidade civil dos estabelecimentos de ensino e demais responsáveis nos casos de bullyinge cyberbullying, orientando-se a partir de teses, dissertações e artigos produzidos no Brasil, entre os anos de 2013 e 2022. Concernente ao procedimento metodológico, trata-se de uma pesquisa de cunho bibliográfico do tipo revisão de literatura, na qual se realizou um levantamento sistemático no Catálogo de Teses de Dissertações da Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (CAPES) e nos Periódicos da CAPES. Foram encontrados, inicialmente, 78 estudos. Aplicados os critérios de nclusão e exclusão, foram selecionados 12 estudos, sendo 02 teses, 03 dissertações e 07 artigos, para compor o corpusde análise. Os resultados revelaram que, na maioria dos estudos jurídicos revisados, os pais são apontados como responsáveis pela educação dos filhos, devendo haver um maior cuidado em relação ao uso dos dispositivos eletrônicos. Evidenciaram, ainda, que os estabelecimentos de ensino têm deveres jurídicos para impedir, coibir e lidar com situações de bullyinge cyberbullying, não podendo se isentar dessa obrigação. Chegou-se à conclusão de que cabe ao Estado elaborar e implementar políticas públicas para proporcionar a adequada inserção das crianças e dos adolescentes no ambiente digital, ao promover medidas de caráter preventivo adequadas e efetivas para protegê-los deriscos de danos à sua esfera existencial.
