Resumen de Procedimiento administrativo de visto bueno: Enfoque Constitucional a la seguridad jurídica y al debido proceso

  El Código de Trabajo Ecuatoriano, contempla el trámite administrativo de visto bueno, como primera opción para resolver conflictos laborales, este proceso debe garantizar los derechos consagrados en la Constitución, el problema de este trámite se ocasiona al disponerse en el Código de Trabajo que ha falta de un procedimiento propio se utilice de forma supletoria el procedimiento contemplado en el Código Orgánico General de Procesos (COGEP). En virtud de lo expuesto, el objetivo de ésta investigación es garantizar los derechos consagrados en la Constitución del Ecuador, para tal efecto se ha utilizado los métodos histórico lógico, método hipotético deductivo y lógico inductivo, para  justificar la necesidad de crear un procedimiento propio para la sustanciación del trámite administrativo, finalmente otorgar a la resolución de visto bueno, fuerza de fallo para garantizar el derecho al debido proceso y  seguridad jurídica.

  The Ecuadorian Labor Code, contemplates the administrative procedure of approval, as the first option to resolve labor disputes, this process must guarantee the rights enshrined in the Constitution, the problem of this procedure is caused by being provided in the Labor Code that is missing of a proper procedure, the procedure contemplated in the General Organic Code of Processes (COGEP) is used in a supplementary manner. By virtue of the foregoing, the objective of this investigation is to guarantee the rights enshrined in the Constitution of Ecuador, for this purpose the logical historical methods, deductive hypothetical method and inductive logic have been used, to justify the need to create a proper procedure for the substantiation of the administrative procedure, finally granting the resolution of approval, force of failure to guarantee the right to due process and legal certainty.
