    From 1811 to 1976, four mining codes succeeded each other in Chile. This legal instability shows difficult it was for the legislator to abandon the colonial legal system and to adjust to the mining reality of the country. Yet, not all of the mining system was subject to changes: State’s prerogatives were not concerned with the reforms. The particular link between the State and the mines was long seen as belonging to the eminent domain. The 1971 constitutional reform compelled the authors to question this assessment.

    De 1811 à 1976, quatre codes miniers se sont succédé au Chili. Cette instabilité juridique témoigne des difficultés du législateur à se défaire des dispositions coloniales et à s’adapter à la réalité minière du pays. Un aspect du régime minier échappe cependant aux changements législatifs : les prérogatives de l’Etat. Ce lien particulier entre l’Etat et les mines fut pendant longtemps analysé comme relevant du domaine éminent. La réforme constitutionnelle de 1971 va obliger la doctrine à remettre en cause cette analyse.
