    Si Jorge Gracia —oriundo de Calamocha— hubiera fallecido hace treinta años, las tradicionales instituciones —contempladas en el artículo 317 del Código del Derecho Foral de Aragón— hubieran determinado finalmente el destino de sus bienes de forma pacífica. Tres décadas después asistimos a una verdadera metamorfosis en la materia y es que los clásicos bienes —con unos caracteres eminentemente patrimoniales— coexisten en la actualidad con otros relacionados con los entornos digitales y este extremo —sumado a ciertas imprecisiones en el lenguaje utilizado por el legislador nacional y que posteriormente expondremos— determina que debamos analizar si están preparadas nuestras instituciones para resolver la sucesión de los ciudadanos en estos concretos asuntos. Este breve artículo pretende, por tanto, confirmar la idoneidad y vigencia del régimen normativo que regula el destino de los bienes del causante o si, por el contrario, resulta necesario realizar en el mismo algún ajuste de mayor o menor calado.

    If Jorge Gracia – a native of Calamocha – had died thirty years ago, the traditional institutions – contemplated in article 317 of the Código del Derecho Foral de Aragón – would have finally determined the destination of his assets peacefully. Three decades later we are witnessing a true metamorphosis in the matter and that is that the classic assets – with eminently patrimonial characteristics – currently coexist with others related to the personality of the deceased and this extreme – added to certain inaccuracies in the language used by the national legislator and that we will expose later – determines that we must analyze if our institutions are prepared to resolve the succession of citizens. This short article aims, therefore, to confirm the suitability and validity of the normative regime that regulates the destination of the assets of the deceased or, on the contrary, it is necessary to make some adjustment of greater or lesser depth in it.
