El presente trabajo tuvo como objetivo analizar las diferentes posiciones teóricas que en el mundo contemporáneo se establecen respecto la responsabilidad jurídica que se le atribuye a los sistemas de IA a partir de hechos acontecidos o ejecutados por estos algoritmos, considerando su autonomía en la toma de decisiones a partir de su aprendizaje autónomo. Si bien el desarrollo de la IA debiera dotar a la humanidad de incontables beneficios, cuando existe afectación, daño o puesta en peligro de bienes jurídicos protegidos por el derecho se hace necesario determinar sobre quién recae la responsabilidad jurídica si la decisión que causó el agravio fue del sistema de Inteligencia artificial.
The present work aimed to analyze the different theoretical positions that in the contemporary world are established regarding the legal responsibility attributed to AI systems from events that occurred or executed by these algorithms, considering their autonomy in decision-making from their autonomous learning. Although the development of AI should provide humanity with countless benefits, when there is affectation, damage or endangerment of legal assets protected by law, it is necessary to determine who bears the legal responsibility to answer if the decision that caused the grievance was the artificial intelligence system.
