    Los cónyuges o los futuros esposos en ocasiones prevén convencionalmente consecuencias derivadas de la falta de fidelidad en su matrimonio. El presente trabajo aborda su estudio desde que se registran este tipo de documentos, analizando los argumentos a favor y en contra de su validez, así como los principales problemas que pudieran plantearse, teniendo en cuenta los diferentes contextos históricos y jurídicos, desde el Egipto grecorromano hasta el momento presente, pasando porla Roma clásica y la época bizantina, con particular atención a la actual práctica norteamericana.

    Spouses or future spouses sometimes provide for consequences arising from the lack of fidelity in their marriage by agreement. The present paper approaches its study from the time this type of documents is recorded, analysing the arguments for and against their validity, as well as the main problems that may arise, taking into account the different historical and legal contexts, from Greco-Roman Egypt to the present day, going through classical Rome and Byzantine times, with particular attention to current North American practice.
