Resumen de European Union Law and the Contra Legem Principle

  • This article concerns the contra legem principle and its effect on the case law of the European Court of Justice (ECJ). Although courts should not behave contra legem, analysis of the case law of the ECJ reveals several instances where it appears to have done so. There also appear to be some cases that seem sub silentio to have been decided contra legem and others that may be considered borderline. The cases concerned are analysed and consideration given to the future involvement of the General Court.
