Resumen de Linguistic turn, Wittgenstein, Gadamer e o direito

  The paper deals with the linguistic turn and two relevant theories that derive from it: the Ordinary Language Philosophy, of L. Wittgenstein, and the Hermeneutic Philosophy, of H. G. Gadamer. The purpose is to ananalyze the contribution of such movements to the overcoming of the Positivistic paradigm in Law. In order to do so, the Hermeneutic method is used together with the procedures of bibliographical research in a qualitative approach.

  O artigo aborda a viragem linguística e duas relevantes teorias dela decorrentes – a filosofia da linguagem ordinária, de L. Wittgenstein, e a hermenêutica filosófica, de H.-G. Gadamer – e tem como objetivo analisar suas possíveis contribuições para a superação do paradigma positivista no direito. Para isso, emprega o método hermenêutico, os procedimentos da pesquisa bibliográfica e a abordagem qualitativa.
