    El presente trabajo trata de fundamentar la tesis del autor según la cual es posible obtener la validez material de una declaración de autoría sobre una obra literaria presentada en el Registro de la Propiedad Intelectual sin haber realizado el abono de la tasa obligatoria, mediante una actuación torticera, pero legal. Se examina la situación en la cual un interesado procede a solicitar la inscripción de su obra en el Registro de la Propiedad Intelectual, pero no realiza nunca el preceptivo abono de la tasa por el trámite. En tal situación, se declara el desistimiento del procedimiento, pero en un tiempo futuro el autor apela a dicho procedimiento archivado para demostrar la autoría de la obra que pretendía inscribir.

    This work tries to substantiate the author's thesis according to which it is possible to get the material validity of a declaration of authorship on a literary work presented in the Intellectual Property Registry without the previous payment of the mandatory fee, through an underhand action, but legal. This work examines the situation in which an interested party proceeds to request the registration of his work in the Intellectual Property Registry, but never makes the mandatory payment of the fee for the procedure. In such a situation, the withdrawal of the procedure is declared, but in a future time the author appeals to that archived procedure to demonstrate the authorship of the work that he intended to register.
