¿Cómo debe interpretarse una sustitución vulgar en favor de los descendientes “por estirpes”?

  ¿Cómo ha de interpretarse una sustitución vulgar de los descendientes ordenada por estirpes? En particular, debe determinarse si en tal caso juegan, o no, los principios de que el grado más próximo excluye al más remoto, de si juega, o no, una especie de derecho de representación y de si, en su caso, la repudiación de un sustituto opera por sí y por su estirpe. Y ha de establecerse si nos hallamos en sucesión intestada, testamentaria y/o legitimaria, con el juego respectivo del derecho de representación, el derecho de acrecer y el juego en su caso de una sucesión intestada ex art.912 C.c.

  How is it to be intended a vulgar substitution in favour of the descendants « in stirpes » ? Id est, it ought to be decided whether in that case do apply the principles that the closer grade excludes the farther and that the renunciation excludes the repudiator and his descendants. Furthermore, it is to be established whether the inheritance is devolved by the right of representation. It is also to be settled whether we are in testate or intestate succession, with, eventually, reserved rights («portio legitima»). «Ius adscrescendi».
