Resumen de Nuevas tecnologías y derechos digitales laborales en la negociación colectiva

  Las nuevas tecnologías de la información han revolucionado todas las facetas de la vida. Las relaciones de trabajo no son una excepción. Las tecnologías digitales han diluido y relativizado elementos nucleares de la relación laboral, como, entre otros muchos, el lugar o el tiempo de trabajo. Tanto la normativa europea como la legislación nacional ya han establecido el marco regulador básico de los derechos digitales de los trabajadores. Pero no es suficiente, es necesario que la negociación colectiva implemente y desarrolle dicho marco normativo. Pero qué acogida real está teniendo en la negociación colectiva, qué nuevos contenidos incorporan los convenios colectivos y qué aspectos laborales han tenido que adaptarse a la generalizada irrupción de las nuevas tecnologías digitales, qué problemas y disfuncionalidades se detectan en la regulación convencional de las TIC y de los derechos digitales laborales. Este es el objeto del presente estudio.

  The new ICT have revolutionized all facets of life. Work relationships are no exception. Digital technologies have diluted and relativized core elements of the employment relationship, such as, among many others, the place or time of work. Both European regulations and national legislation have already established the basic regulatory framework for workers’ digital rights. But it is not enough, it is necessary for collective bargaining to implement and develop this regulatory framework. But what real reception is it having in collective bargaining, what new content do collective agreements incorporate and what labor aspects have had to adapt to the widespread irruption of new digital technologies, what problems and dysfunctionalities are detected in the regulation by the collective agreement of ICT and of digital labor rights. This is the object of the present study.
