Resumen de Constitución de la Junta de Acreedores en el Texto Refundido de la Ley Concursal

El Real Decreto Legislativo 1/2020, de 5 de mayo, por el que se aprueba el Texto Refundido de la Ley Concursal, ha introducido modificaciones en la sistemática y en la redacción literal de los preceptos de la derogada Ley Concursal, en lo que se refiere al régimen jurídico de la aceptación de propuestas ordinarias de convenio en el seno de las juntas de acreedores celebradas en el marco de los procedimientos concursales. En este sentido, el presente trabajo tiene por objeto examinar el alcance de dichas modificaciones y su posible incidencia en la interpretación de los preceptos relativos a la constitución de la junta, lo que requiere aproximarse, igualmente, a la disciplina de la convocatoria de la junta, de la mesa de la junta y de la lista de asistentes.

Royal Legislative Decree 1/2020, of May 5, which approves the Consolidated Text of the Insolvency Law, has introduced modifications in the systematic and in the literal wording of the articles of the Insolvency Law, in what is refers to the legal regime for the acceptance of ordinary agreement proposals within the creditors’ meetings held within the framework of insolvency proceedings. In this sense, the present work aims to examine the scope of said modifications and their possible impact on the interpretation of the articles relating to the constitution of the meeting, which requires an approach, likewise, to the discipline of calling the meeting, the board table and the list of attendees.
