  El objetivo del texto tiene como finalidad realizar un análisis del embrollo procesal jurídico referido a la inmunidad del Sr. Junqueras, al hallarse en situación de prisión provisional y no poder adquirir la condición plena de eurodiputado. El Tribunal de Justicia a diferencia del Tribunal Supremo sostiene que una persona elegida adquiere condición de europarlamentaria, como resultado de las elecciones una vez proclamado por la Junta Electoral. A través del mismo puede comprenderse algunas problemáticas jurídicas surgidas en ese proceso.

  The aim of the text is to carry out an analysis of the legal procedural mess related to the immunity of Mr. Junqueras, as he is in a provisional prison situation and cannot acquire the full status of MEP. The Court of Justice, unlike the Supreme Court, holds that an elected person acquires the status of an MEP, as a result of the elections once proclaimed by the Electoral Junta. Through it, some legal problems that have arisen in this process can be understood.
