      En la doctrina del Tribunal Constitucional, la categoría de la “vulneración indirecta” de los derechos fundamentales ha sido utilizada para impedir el reconocimiento u homologación de resoluciones extranjeras que, por resultar contrarias a estándares generales de interpretación de los derechos humanos, comprometen la idea misma de dignidad humana. Al hilo de tal doctrina, la reciente STC 132/2020, de 23 de septiembre, parece sugerir que ciertas exigencias del derecho de defensa, supuestamente inherentes a la idea de dignidad humana, pueden ser ignoradas dentro del espacio de cooperación judicial de la Unión Europea pero no en la cooperación con terceros estados, para los que regiría un estándar diferente de dignidad. A nuestro juicio, esta es una interpretación que desfigura la categoría de las vulneraciones indirectas y que puede tener derivas preocupantes en el futuro, como la relativización del papel de los derechos humanos en la conformación de la identidad europea, el favorecimiento de una política judicial de tutelaje constitucional de terceros estados y la alteración de las reglas que hasta ahora han regido las relaciones del Tribunal Constitucional español con el ordenamiento jurídico de la Unión.

      In the doctrine of the Spanish Constitutional Court, the category of”indirect infringements”of a fundamental right has been used to prevent the recognition or homologation of foreign resolutions that, because they are con-trary to general standards of interpretation of human rights, compromise the idea of human dignity. The recent STC 132/2020 of 23 September appears to suggest that certain requirements of the right to defense, supposedly inherent to the idea of human dignity, can be ignored within the European Union’s area of judicial cooperation, but not in the cases of cooperation with third States, for which a different standard of dignity would apply. In our opinion, this is an interpretation that disfigures the category of indirect infringements and that may have worrying deviations in the future, such as the relativization of the role of human rights in the shaping of European identity, the promotion of a judicial policy of constitutio-nal imperialism upon third states and the alteration of the rules that have so far governed the relations of the Spanish Constitutional Court with the legal system of the Union.
