Las litis expensas a la luz del Proyecto de Ley de Asistencia Jurídica Gratuita

    El beneficio de justicia gratuita y la litis expensas son figuras cuya convivencia no ha sido pacífica, coexistiendo en la práctica judicial varias corrientes de opinión opuestas, que han desembocado en la Sentencia del Tribunal Supremo n.º 184/2012 cuya doctrina -matizable, creemos- arroja más luz al estado actual de la cuestión. Pero el Proyecto de Ley de Asistencia Jurídica Gratuita, que se está tramitando actualmente en las Cortes, trata esta cuestión de forma significati-va con la modificación del artículo 1318, III del Código Civil, lo que supondrá, de aprobarse, un giro muy significativo en la relación entre litis expensas y justicia gratuita.

    The benefit of legal aid and the judicial costs are figures whose co-existence has not been peaceful, coexisting in the judicial practice several opposing currents of opinion that have led to the judgment of the Tribunal Supremo (Supreme Court) no. 184/2012 whose doctrine -which in our opinion should be refined- sheds more light to the current state of the question. But the Draft Law on Legal Aid, which is currently being dealt with in the Spanish Parliament, addresses this issue in a meaningful way with the amendment of Section 1318, III of the Civil Code, which will give, in case of its adoption, a very significant turn in the relationship between judicial costs and legal aid.
