En el artículo se plantea el alcance de las potestades municipales para la ordenación de las viviendas de uso turístico. Para ello, en primer lugar, se conceptúa jurídicamente la actividad como servicio turístico y se expone el posicionamiento crítico de la CNMC ante su regulación. En segundo lugar, se valora la competencia municipal sobre urbanismo como título habilitante para la eventual adopción de medidas de ordenación. En tercer lugar, se describen los principales instrumentos urbanísticos específicos aprobados y se examina la jurisprudencia recaída en relación con los mismos. En base a lo anterior, finalmente se trata de delimitar la competencia de ordenación municipal urbanística sobre las viviendas de uso turístico y las razones imperiosas de interés general que pueden justificarla.
In the article the scope of the municipal powers, for the organization of the houses of tourist use is raised. For this, in the first place, the activity as a tour ist service is legally conceptualized and the critical position of the CNMC before its regulation is exposed. Secondly, municipal jurisdiction over urban planning is valued as an enabling title for the eventual adoption of management measures. Thirdly, the main specific urban planning instruments approved are described, and the case law related to them is examined. Based on the aforementioned, finally, it is a question of delimiting the competence of municipal urban planning on tourist use housing and the compelling reasons of general interest that may justify it.
