En el presente trabajo su autor comenta la Resolución de la Dirección General de Seguridad Jurídica y Fe Pública de 1 de junio de 2020 que, con acierto, vino a aplicar el nuevo art. 17.12 de la Ley de Propiedad Horizontal, que por una mayoría de tres quintos adoptado como acuerdo estatutario por la comunidad de vecinos permite prohibir los alquileres turísticos del art. 5.e) de la Ley de Arrendamientos Urbanos, computando a tal efecto los votos de los vecinos ausentes en la Junta y no disidentes del acuerdo aprobado; aunque siempre distinguiendo entre lo que puede ser, o no, válido y eficaz, para la comunidad que aprobó el acuerdo y para terceros, posibles futuros adquirentes de pisos y vecinos de dicha comunidad, que no se verán afectados por el acuerdo si este no es previamente inscrito en el Registro de la Propiedad, conforme exige el art. 5.III de la Ley de Propiedad Horizontal.
In this work, the author comments on the Resolution of the General Directorate of Legal Security and Public Faith of June 1, 2020 that, with success, came to apply the new art. 17.12 of the Horizontal Property Law, which by a majority of three fifths adopted as a statutory agreement by the community of neighbors allows the prohibition of tourist rentals of art. 5.e) of the Urban Leasing Law, counting for this purpose the votes of residents absent from the Board and not dissenting from the approved resolution; although always distinguishing between what may or may not be valid and effective, for the community that approved the agreement and for third parties, possible future purchasers of flats and residents of said community, who will not be affected by the agreement if it is not previously registered in the Property Registry.
