Resumen de De los permisos parentales a la conciliación: Expectativas creadas por la Directiva 2019/1158 y su transposición al ordenamiento español

El artículo presenta un análisis crítico de la, recientemente aprobada, Directiva 2019/1158 de conciliación de la vida familiar y profesional. Es un análisis detallado, que conecta el contenido de la actual Directiva con el de las anteriores directivas (no solo de permisos parentales, sino también de maternidad y de no discriminación por razón de género) y con la jurisprudencia del TJUE. A lo largo de todo el trabajo se pone en conexión la normativa y jurisprudencia de la Unión Europea con la normativa interna española sobre la materia, particularmente a partir de lo establecido en el RDL 6/2019, de 1 de marzo, para identificar desarrollos y discordancias. Los hilos conductores de todo el trabajo son los objetivos de corresponsabilidad y promoción de la adaptación del tiempo de trabajo que dicen perseguir tanto la nueva Directiva de la UE como la nueva norma española y que no siempre consiguen.

The paper presents a critical analysis of the recently approved Directive 2019/1158 on work-life balance. It is a detailed analysis, which connects the content of the current Directive with that of the previous directives (not only of parental leave, but also of maternity and non-discrimination on the basis of gender) and with the jurisprudence of the CJEU. Throughout all the work, the regulations and jurisprudence of the European Union are connected with the Spanish regulations on the subject, specifically after the Royal Law Decree 6/2019, of March 1, to identify developments and disagreements. The axis of this study are the objectives that the work-life balance Directive and the Spanish new legislation claim to pursue: co-responsibility and promotion of the adaptation of working time. Through the paper it is exposed, though, that these two objectives are not always achieved
