The author examines the origin and affirmation of the principle of favor rei which, from a rhetorical argument used for procedural purposes in the late republic, has been transformed into a real principle of law in the philosophical and cultural climate that characterized the Roman Empire between the first and third centuries AD, finding in Trajan its most valid supporter, and then spread into civil proceedings thanks to the jurisprudence of the time.
