La Suprema Corte torna a pronunciarsi sulle indagini difensive, sostenendo che alla documentazione redatta ad hoc dal difensore bastano i medesimi requisiti formali del corrispondente verbale formato dal pubblico ministero, postulando la qualifica di pubblico ufficiale rivestita dall’avvocato in tali circostanze. Tuttavia, appaiono censurabili gli argomenti che fungono da premessa alle conclusioni.
