Caso “Chevron-Texaco” y “daño ecológico puro”: análisis a la luz de la Directiva 2004/35/CE y la Ley 26/2007, de responsabilidad medioambiental

      Este trabajo analiza la sentencia pronunciada por la Corte Provincial de Sucumbíos de Ecuador, en contra de una de las petroleras más grandes de los Estados Unidos, “Chevron-Texaco” (o caso “Chevron-Texaco”). Se trata de un hecho catastrófico conocido a nivel mundial, incitado por la operación de la actividad extractiva de petróleo, que se llevó a cabo en el suelo de la Amazonía ecuatoriana (1964-1990). Los exorbitantes daños producidos tuvieron una repercusión negativa no solo sobre el ambiente, sino respecto de sus habitantes (comunidades indígenas), afectando incluso, a la propia humanidad. El mecanismo jurídico “idóneo” al que la Corte ecuatoriana recurrió para resolver el caso, fue el de responsabilidad civil extracontractual (influencia directa del sistema civil clásico español). No obstante, la característica primordial de este régimen, es lograr la reparación/compensación del daño, a través de una indemnización pecuniaria; opción limitada o eliminada por el instituto de responsabilidad ambiental (previsto en el orden jurídico comunitario europeo y español). A juicio de la autora, la conducta que dañó el ambiente trae como consecuencia una responsabilidad que difiere de la civil. Es, netamente, de tipo ambiental pero con inclusión de daños tradicionales. Por ello, hipotéticamente, quiere dilucidar si este “daño ecológico puro”, podría ser resuelto con arreglo al contenido normativo prefijado por la Ley española 26/2007 que transpone la Directiva 2004/35/CE (ambos cuerpos normativos de “responsabilidad medioambiental”), en armonía con los principios básicos de Derecho Ambiental, principalmente, el de “Prevención” y de “Quien contamina paga”, o si lo expuesto, únicamente, es un aparente conflicto, que las lagunas del sistema tradicional han trampeado.

      This small paper analyzes the sentence imposed by the Provincial Court of Sucumbíos of Ecuador, against one of the largest oil companies in the United States, “Chevron-Texaco” (or “Chevron-Texaco” case). It is a catastrophic event known worldwide, prompted by the operation of extractive oil activity, which took place in the soil of the Ecuadorian Amazonia (1964-1990). The exorbitant damages produced had a negative repercussion not only on the environment, but with respect to its inhabitants (indigenous communities), affecting even, humanity itself. The legal mechanism “suitable” to which the Ecuadorian Court appealed to resolve the case was the non-contractual civil responsibility (direct influence of the Spanish civil classic system). However, the main characteristic of this regime is to obtain reparation/compensation of the damage, through pecuniary compensation; option limited or eliminated by the environmental responsibility institute (foreseen in the European Community legal order and Spanish). In the opinion of the author, the conduct that damaged the environment results in a responsibility that differs from the civil one. It is, clearly, of the environmental type but with the inclusion of traditional damages. Therefore, hypothetically, there is a want to clarify whether this "pure ecological damage" could be resolved according to the regulatory content prescribed by the Spanish Law 26/2007, which transposed the Directive 2004/35/CE (both regulatory bodies of “environmental responsibility”), in harmony with the basic principles of Environmental Law. Mainly, that of “Prevention” and “Who pollutes pays”, or if only the exposed, is an apparent conflict, that the gaps of the traditional system have tricked.
