    El trabajo analiza los efectos del fallo de inaplicabilidad y las consecuencias prácticas que generan para el juez de la gestión pendiente, quien ve alterada la legislación a aplicar, en el caso de mediar un fallo estimatorio. Lo anterior, puesto que está vinculado por el mandato prohibitivo o negativo que genera la sentencia del Tribunal Constitucional. Luego se revisa cómo han actuado los tribunales de justicia ante ello.
