  In the theory of public enforcement of law the choice of the liability rules is between strict liability and fault-based liability. In this paper, we study the determinants of compliance when in addition to standard economic incentives wrongdoers take into account stigmatization costs. In this context, this cost is not simply a transfer of resources. We show that a non-guiltiness standard — the fault standard equal to the deterrence level — is never optimal. In this scenario, we show how the optimal policy choice depends on the interplay between the magnitude of the harm and the stigmatization cost.

  La mise en oeuvre des règles de responsabilité implique de choisir entre un régime de responsabilité pour faute ou sans faute. Dans cet article, nous analysons les déterminants du respect des règles de droit lorsqu’il existe des coûtes liés à la stigmatisation en plus des incitations économiques standard. Ce coût de stigmatisation ne correspond donc pas à un simple transfert de ressources. Nous montrons que lorsque le standard définissant le régime de responsabilité pour faute est égal au niveau de dissuasion, le résultat n’est jamais optimal. Le régime de responsabilité optimal dépend des montants de dommages constatés et du coût de la stigmatisation.
