Responsabilidad por los daños causados por un vehículo no asegurado estacionado en una propiedad privada y derecho de repetición del organismo de indemnización contra el propietario del vehículo

    La propietaria de un vehículo registrado en un Estado miembro y apto para circular, que se encuentra inmovilizado en un terreno privado, tiene la obligación de suscribir un seguro de responsabilidad civil relativo a la circulación de vehículos aun cuando no tenga intención de ponerlo en circulación. Además, el organismo nacional de indemnización podrá repetir contra la propietaria del vehículo que incumplió la obligación de asegurarlo, por las cantidades satisfechas a consecuencia de los daños causados en un siniestro en el que se vio involucrado el mencionado vehículo, aun cuando su propietaria no sea civilmente responsable. Este es el pronunciamiento del Tribunal de Justicia en el asunto Juliana que resulta de gran transcendencia de cara a la aplicación de la normativa española en esta materia, pues algunas de sus disposiciones pueden resultar controvertidas a la luz de la mencionada decisión tal y como se pone de manifiesto en el presente trabajo

    The owner of a motor vehicle still registered in a Member State and capable of being driven but parked on private land, solely by the choice of the owner who no longer intends to drive it, has the obligation to conclude a contract of insurance against civil liability relating to the use of a motor vehicle. In addition, the National body with the task of providing compensation for damage to property or personal injuries suffered by the victims of the accident, has the right to bring an action against the person who was subject to the obligation to take out insurance in respect of the use of the vehicle which caused the damage or injuries for which compensation was provided by that body, even if that person has no civil liability for the accident in which the damage or injuries occurred. The ruling of the Court of Justice in the Juliana case is of great importance for the application of Spanish legislation in this matter, because some of its provisions may be controversial in the light of the referred decision, as is shown in the present work.
