    En el presente trabajo analizamos la incorporación del derecho humano al medio ambiente sano en la Constitución mexicana. En este orden de ideas, indagamos sobre la manera en que la positivación de la cuestión medio–ambiental implica el reconocimiento de un derecho subjetivo, con contenido propio y eficacia plena ante el Estado y los particulares. Finalmente, esbozamos algunas reflexiones sobre su justiciabilidad a través de la acción de amparo.

    In this paper we analyze the incorporation of the human right to healthy environment in the Mexican Constitution. In this sense, we investigate the way in which the positivization of the environmental issue implies the recognition of a subjective right, with its own content and full effectiveness before the State and individuals. Finally, we outline some reflections on its justiciability through the amparo action
