La Ley Orgánica 3/2018 de 5 de diciembre, de Protección de Datos Personales y garantía de derechos digitales contempla expresamente el derecho al testamento digital. En apretada síntesis, pretende resolver los conflictos de hecho planteados ante la gestión post-mortem de los datos personales, su acceso, por parte de quien así designe el causante, sea en calidad de heredero, legatario, albacea o tercero. En este punto, de los componentes clásicos de la herencia, personales, formales y los reales, ventilaremos si estamos ante una auténtica novedad o si antes bien, el destino de los archivos digitales generados en vida del causante, no son sino una manifestación más de la «huella» de su personalidad, contractual y no contractual. En suma, un elemento de su ámbito personalísimo, cuyo destino —acceso, rectificación, eliminación— puede ser dispuesto en testamento notarial o, incluso, ológrafo, que en el ejercicio de la actual noción de capacidad jurídica, podrán designar menores y personas con la capacidad de obrar modificada.
The Ley Orgánica 3/2018, Bill of Protection of Data of Personal Character contemplates the Right to the digital heritage.
