    Se analiza en el presente supuesto la doctrina establecida por un grupo de sentencia de la Sala Tercera del Tribunal Supremo en relación con las facultades de las ordenes de investigación de un órgano regulador, en este caso, la Comisión Nacional de los Mercados y de la Competencia, cuando de la misma se obtiene información adicional y que puede conseguir el reproche por un tipo infractor diferente a la inicial y, por tanto, al que justifica la propia orden de investigación.
