    El modelo bilateral laboral impone límites a la empresa de no sustitución de huelguistas. El modelo triangular mercantil obliga a paralizar la actividad a una tercera empresa, o a no firmar contrata nueva, con el fin no vaciar de contenido una huelga ajena. La jurisprudencia española está construyendo un matizado modelo triangular mercantil sobre la base de la vinculación por grupo mercantil empresarial. Analizo esta jurisprudencia y reflexiono sobre el alcance en terceras empresas de huelgas ajenas.

    The bilateral labor model imposes limits on the company of not replacing strikers. The triangular mercantile model forces to paralyze the activity to a third company, or to not sign new contract, in order not to empty a foreign strike. Spanish jurisprudence is building a nuanced triangular mercantile model based on the linkage by business mercantile group. I analyze this jurisprudence and reflect on the scope of third-party companies for other strikes.
